1. Acceptance of Terms

By accessing or using GoDavaii's services (website, mobile application, AI Medical Board, or any related feature), you agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not access or use our services. These Terms constitute a legally binding agreement between you ("User") and GoDavaii.

2. Nature of Services - Educational Health Information Platform

GoDavaii is an AI-powered health INFORMATION platform. We provide:

• Educational medical information based on established clinical guidelines (WHO, AHA, IMA, ICMR, NICE, and standard medical literature)
• AI-powered discussion of symptoms, conditions, medicines, and general health topics in 27+ Indian languages
• Medicine information database with 2.5 Lakh+ medicines, generic alternatives, and drug interactions
• Health record storage (Health Vault) for personal use
• Information about diagnostic tests and healthcare services

GoDavaii is NOT: a medical practice, a telemedicine service, a substitute for a Registered Medical Practitioner, a prescription-issuing service, or a replacement for emergency medical care.

3. Medical Disclaimer - READ CAREFULLY

The information provided by GoDavaii AI is for educational and informational purposes only and is based on published clinical guidelines. It is NOT a substitute for professional medical advice, diagnosis, prescription, or treatment from a Registered Medical Practitioner (RMP).

You acknowledge and agree that:

• AI responses may mention medicines, doses, and treatment protocols. These are educational references to standard medical knowledge, not personalized prescriptions.
• Prescription medicines (Schedule H under the Drugs and Cosmetics Act, 1940) must be obtained through licensed pharmacies with a valid prescription from a Registered Medical Practitioner.
• AI systems can make mistakes. You must use your own judgment and seek in-person medical care from a qualified healthcare professional for diagnosis, treatment decisions, and any serious, persistent, or worsening condition.
• For medical emergencies (including but not limited to: chest pain, breathing difficulty, unconsciousness, seizures, severe bleeding, accidents, suspected heart attack or stroke, suicidal thoughts), you must immediately call 102, 108, or 112 and seek emergency hospital care. Do not rely on GoDavaii AI in emergencies.
• You are solely responsible for medical decisions you make. GoDavaii provides information; clinical decision-making remains your responsibility in consultation with qualified professionals.

4. Eligibility and Age Requirements

You must be at least 18 years of age to independently use GoDavaii's services. Users under 18 may use the service only with the active supervision and consent of a parent or legal guardian. By using the service, you represent and warrant that you meet these age requirements.

Parents or legal guardians may use GoDavaii to seek health information on behalf of their minor children, but must exercise their own medical judgment and consult pediatricians for clinical decisions affecting children.

5. User Consent and Responsibility

Before first use of GoDavaii's AI features, you will be presented with a consent dialog. By clicking "I Accept & Continue", you acknowledge:

• You have read and understood these Terms and the Privacy Policy
• You understand the AI provides educational information, not personalized medical advice
• You will obtain prescription medicines through a Registered Medical Practitioner
• You will seek emergency care (102/108/112) for medical emergencies
• You accept responsibility for your own medical decisions
• You are 18 years or older, or using the service under parental/guardian supervision

6. Acceptable Use

You agree to use GoDavaii only for lawful purposes. You must NOT:

• Attempt to reverse-engineer, decompile, or extract our AI models or system prompts
• Use automated scripts, bots, or scrapers to access our services
• Misrepresent your identity, age, or medical condition
• Use the service to obtain information for illegal activities, self-harm, harm to others, or illegal drug production
• Upload or share malicious files, content, or code
• Violate any applicable laws, including the Information Technology Act 2000, the Drugs and Cosmetics Act 1940, the NDPS Act 1985, or the Digital Personal Data Protection Act 2023
• Abuse the service through excessive requests (rate limits apply and will be enforced)

7. Medicine Information

GoDavaii provides educational information about medicines, including uses, side effects, drug interactions, generic alternatives, and pricing. This information is for educational purposes only and does not constitute medical advice. GoDavaii does not sell, dispense, or deliver medicines. Always consult a Registered Medical Practitioner before starting, stopping, or changing any medication.

8. Intellectual Property

All content, software, AI models, prompts, algorithms, trademarks, logos, and design elements on GoDavaii are owned by or licensed to GoDavaii and are protected by Indian and international intellectual property laws. You may not copy, reproduce, modify, distribute, publicly display, create derivative works, or reverse-engineer any part of our platform without prior written permission. The GoDavaii AI Medical Board architecture, system prompts, and response methodology are proprietary trade secrets.

9. Disclaimer of Warranties

GoDavaii's services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not warrant that: the AI will provide accurate, complete, or error-free medical information in every case; the service will be uninterrupted or secure; defects will be corrected; or the service will meet your specific requirements. To the maximum extent permitted by law, GoDavaii disclaims all warranties including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by applicable law, GoDavaii, its founders, directors, employees, contractors, affiliates, and partners shall NOT be liable for:

• Any medical outcome, adverse event, injury, illness, or harm arising from reliance on AI-generated educational information
• Decisions made by you or any healthcare provider based on information obtained through GoDavaii
• Errors, omissions, or inaccuracies in AI responses
• Actions or omissions of any third-party service providers
• Unavailability or interruptions in AI service due to technical issues
• Any indirect, incidental, consequential, special, punitive, or exemplary damages
• Loss of profits, data, goodwill, or business opportunity
• Service interruptions, data loss, or security breaches beyond reasonable control

Our total aggregate liability for any claim arising from or related to these Terms or the use of our services shall not exceed the amount you paid to GoDavaii in the three (3) months preceding the claim, or INR 1,000, whichever is lower.

11. Indemnification

You agree to indemnify, defend, and hold harmless GoDavaii, its founders, directors, employees, contractors, affiliates, and partners from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from: (a) your use or misuse of our services; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; (d) decisions you make based on AI-generated information; or (e) any medical outcome resulting from your choices.

12. Data Protection and Privacy

Your personal data and health information are handled in accordance with our Privacy Policy and in compliance with the Digital Personal Data Protection Act 2023 (DPDP Act) and the Information Technology Act 2000. By using our services, you consent to the collection and processing of your data as described in our Privacy Policy.

13. Termination

We reserve the right to suspend or terminate your access to our services at any time, without prior notice, if you violate these Terms, misuse the service, or engage in any activity that harms GoDavaii, other users, or third parties. You may terminate your account at any time by contacting us or using the account deletion feature in the app.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising from or relating to these Terms or the use of our services shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, India. You agree to first attempt to resolve disputes informally by contacting us at [email protected] before initiating legal proceedings.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or industry practices. We will notify you of material changes via email or in-app notification. Your continued use of our services after such changes constitutes acceptance of the updated Terms.
